Irrigation rules and regulations

For Condo, Villa, and Single Family Homes

Introduction / Overview

Lakewood’s primary source of water for irrigation is provided by Collier County Reuse

Department, which recycles wastewater as Irrigation Quality for the expressed purpose as

irrigation. Lakewood Community Services is responsible to supply water up to the clock (timer)

controlled valve of each condo, villa and single family home. Periodic shut down of the system

occurs when there is significant rainfall, a mainline break occurs, the county reuse department

has a failure, maintenance, etc. Any shutdown will be at the discretion of the LCS Board of

Directors and / or the Irrigation Manager. All clocks are to remain on standard time only, with no exceptions.

Lakewood Community Services Responsibilities

1) To maintain and repair or replace clocks (timers) as needed, monitor irrigation pumps,

effluent water regulating equipment and pressure.

2)  To program the clocks (timers) for watering times.

3) To manage all resources with minimal waste and abuse.

4) To assist all residents with any questions or help with understanding of the timers, leaks, valves or interrupted services.

5) LCS and its contractors are not responsible for trees or plantings on maintenance

easements etc. or other landscaping surrounding or over LCS components.

6) LCS contractors are to be allowed indiscriminate access to any and all exterior

components.

7) To facilitate service and location of valves diaphragms, gate valves and solenoids. These

components shall be located above ground

Homeowners Responsibilities

1)  Any items after the clock (timer) and timer controlled valves are the homeowner’s

responsibilities such as sprinkler heads, distribution pipes and other components. Failure

of any component beyond the timer controlled valve need to be replaced in a prompt

matter. Component failure can cause lack of overall system pressure, hazardous

washout holes, increased water usage with higher water bills, and will cause lawns and

landscape to suffer and or perish.

2)  A licensed and insured irrigation contractor may manually turn on the irrigation system to

facilitate repairs to the homeowner’s irrigation system. The timer must be returned to the

“automatic” mode. However no contracted lawn, sprinkler maintenance personnel or

homeowner may adjust or tamper with LCS programming of the timer. (DO NOT TOUCH

THE CLOCKS).

3)  Homeowner must supply and maintain an external outlet within 5 feet of the timer, as a

power source for the clock.

4)  Report any extended periods of power interruptions to LCS or any other abuse of the

system or resources.

5) Avoid planting and/or remove all plantings within 3 feet of any LCS components to

facilitate locating and repairs.

6) No structures or immobile objects are to be placed near the irrigation equipment that

would hinder the servicing of the equipment.

7) Sprinklers must not be used to combat frost at any time.

8) Homeowners must notify LCS of any construction or modifications to any home, which

will affect the irrigation, in order for LCS to inspect or have approved by the irrigation

manager.

9)  All LCS irrigation clocks and valves must be located outside of any fenced in area, or

structure of any living unit.

10) The cost of any and all damage to LCS will be at the expense of homeowner.

11) Due to rain shutdowns or extended repair periods, the homeowner must be prepared to

supplement the watering of new or stressed plantings with hoses using an automatic shut

off nozzle or portable sprinklers with an inline timer set for no longer than 25 minutes.

12) No hose bibs or attachments of any type are to be incorporated into the irrigation system

due to the use of non-potable effluent water for the irrigation system.

13) At no time may an owner or anyone authorized by an owner or homeowner association

representative (other than one appointed by LCS ) be permitted to modify the controls of

any supply side equipment , including but not limited to the effluent water control

assembly, the pumping system or any of the related valves or hardware.

14)  Rain sensors must not be overridden, bypassed, disconnected, or defeated or

reconfigured in any way.

Homeowners Manual Operation Usage

1) Operation of the landscape irrigation system is prohibited daily between 10:00 am and

4:00 pm.

2) The landscape irrigation systems may be operated for cleaning and maintenance no

more than once per week, the run time not to exceed 10 minutes for any one test with

an attendant on site in the area being tested.

3) Irrigation for the purposes of watering insecticides , fungicides and herbicides shall be

accomplished during normal run day and time unless a professional licensed applicator

has posted a temporary pesticide sign containing the date of application and the need

for watering.

Covenant and Rule Enforcement: Dispute Resolution

As provided in Article 2 of the Articles of Incorporation, LCS has the power to enforce all

covenants, conditions, restrictions and agreements applicable to any real property in the

Lakewood project, and is further empowered to promulgate and enforce administrative rules and regulations governing the use of common areas and improvements. Enforcement actions for damages, or for injunctive relief, or both, may be brought by Association against;

  • The owner of any living lot or unit
  • Any homeowners, condominium or villa association which fails to make a reasonable effort to enforce any restrictive or affirmative obligations of the provisions of the Declarations or the association’s own constituent documents, where such failure has an adverse impact on the appearance of the community or the operation of the LCS association.

The enforcement of covenants, conditions, restrictions and agreements to the various

subdivisions and developments within the Lakewood project is primarily the function and duty of the respective Homeowners, Villa and Condominium associations. It is the intent of this provision that LCS exercise its covenant enforcement powers only in the case of a violation which has material adverse effects on a substantial portion of the Lakewood project., and then after the association primarily responsible for enforcement has failed to do so.
